The Customer means you – the person responsible for the Internet account.

Where the customer is not over the age of 18 years, children who use WIS are assumed to have parental or guardian consent to do so.

The customer is responsible for providing and maintaining all of all their own equipment and software necessary to access our service. WIS will endeavour to help all customers who require help with problems that may arise while using the Internet. WIS provides a setup CD at a small charge to assist the customer in setting up their computer to access our service.

The customer is responsible for all telephone charges incurred when they dial WIS, and for determining what STD or other telephone charges apply to the WIS number they are dialling.

All payments due by the customer to WIS are payable in advance. The customer acknowledges that they will be liable for additional charges for excess Internet usage. Any invoiced account must be paid within 7 days of the invoice date otherwise the account will become inactive. Once an account becomes inactive, the customer shall not be able to use their account until all monies are paid to WIS. The customer is responsible for all Invoices and session reports sent via email to the customers email address. After 60 days, if WIS are not notified, the account may be deleted from WIS equipment including all email etc.

The customer must not deliberately or carelessly do anything which damages WIS equipment, software, setup or services. Any person who attempts to do so will have their account terminated and be liable for any monies for any repairs.

The customer must not use their Internet access to annoy, harass or harm other Internet customers. The customer must not use their Internet access for any unlawful purpose or in any unlawful manner. Unless the customer has an account with WIS identified as a commercial/permanent account, the customer will not use their Internet access for commercial/permanent purposes. The sending of bulk e-mail (spamming) is strictly forbidden and the customers account will be immediately terminated.

Any IP Address allotted to the customer by WIS, either as a static address or dynamically allocated, remains the sole property of WIS, and may be changed or revoked by WIS at its discretion at any time. The customer is liable for any telephone service charges incurred in respect of any telephone line used by the customer to dial up WIS Internet equipment.

The customer must have an active, paid for, monthly Internet account with WIS to keep their email address with WIS.

WIS may terminate the customer’s Internet access immediately if the customer breaches this agreement or the rules, or fails to promptly pay any money owed to WIS.

The customer may terminate their account immediately and shall pay any monies outstanding when terminating their account.

The customer acknowledges that:

Continuity and connection speed of customers Internet access depends on a wide range of factors, many of which are beyond the control of Waterfront Internet Service.

By signing the WIS ADSL & Dial up application form, they are asking WIS to provision an ADSL connection and the customer is fully responsible for all charges incurred in this procedure.

Waterfront Internet Service has no control over the accuracy or appropriateness of any information on the Internet. We do however, provide free Spam & Virus Filtering on our Email Server (Google Apps), but do not guarantee that virus’s or spam will not get through to the end user.

Waterfront Internet Service is not responsible for any software available on the Internet. Customers who download and use such software do so at their own risk.

While Waterfront Internet Service endeavour to provide constant Internet access to customers, Internet access may be interrupted by equipment failure, routine maintenance, peak demand, etc

Maximum modem connection speeds may not be achievable at the maximum theoretical speed of the customer’s modem due to line quality, line noise, 3rd part devices, etc.

At all times WIS, will in its best endeavours, keep Internet access available continuously. However due to unseen circumstances, WIS makes no guarantees that access will be available at all times and will not be held liable for any losses whatsoever that may be incurred by the customer as a result of the customers inability to gain access to the Internet. The customer indemnifies WIS against any liability, claim, action, suit, demand, loss, cost or expense whatsoever arising out of or in any way connected with this agreement or Internet access, including any negligence WIS or their resellers.

WIS may impose session time limits in the interest of improved network performance for all users.

WIS may delete without notice any material found on its storage disks which is unauthorised, unlawful, obscene, excessive in volume, uncollected for an excessive period, in an unauthorised place or dangerous.

WIS reserves the right to change any or all of these terms and conditions. Any changes will be made available on the WIS web page. All amendments to the terms and conditions are effective to all customers within seven days.

All ADSL plans are permanent plans, when your computer is on, you are connected to the Internet and can stay connected for as long as you like. You can not host any web servers, email servers, news servers or run an ISP on an ADSL connection and doing so will result in the termination of your account. Contracts are for a 12 month period but can be terminated early by paying a $105.00 disconnection fee. Plans/Speeds can be changed mid contract but there will be a $29.00 fee for each plan change. All plans have a $105.00 setup fee which is for the conversion of your line to ADSL. Extra charges may apply where applicable, please check with Telstra for additional line charges. Plans do not include an ADSL modem, these need to be purchased separately. Please note that this service is NOT available from all locations. Please call to enquire if ADSL is available in your area. All ADSL accounts must be kept in credit at all times.

Acceptable Use Policy

1. About the Policy

As part of our aim to provide a quality service at a reasonable price to all our users, we have implemented this Policy to ensure that each subscriber’s use of the Service:

Meets legal requirements;

does not unreasonably interfere with other subscribers;

and does not unreasonably impact on our ability to provide the Service.

In this document, the following words have these meanings:

you means a subscriber to the Service, or any person who accesses the Service using the subscriber’s access details;

Policy means this document, as may be amended by Waterfront Internet Service from time to time on 14 days notice;

Service means a residential Internet dial-up service provided by Waterfront Internet Service, together with associated services and software such as email facilities, web space and customer support.

2. When this Policy comes into effect

This Policy applies immediately if you are a new subscriber to the Service. For current Users, this Policy applies 14 days after this Policy is posted on Waterfront Internet Service’s website. If any changes are made to this policy by Waterfront Internet Service, these changes come into effect 14 days after the revised policy is posted on Waterfront Internet Service’s website.

3. Security

3.1 Passwords

You must keep confidential the password you use to subscribe to the Service. You remain responsible for any use of the Service made using your password.

3.2 Unauthorised access

You must not attempt to obtain unauthorised access to any computer system, including unauthorised access to Waterfront Internet Service’s system (for example, by attempting to use the account of another user).

3.3 Attacks on third party systems

You must not participate in any attempt to cause any computer system (including Waterfront Internet Service’s system) to malfunction, whether by way of viruses, worms, trojan horses, denial of service attacks or otherwise.

4. Electronic Mail

You must not use the Service to distribute electronic communications (including electronic mail, SMS messages, chat messages and newsgroup postings):

to a person or group who has indicated that they do not wish to receive the communication from you;

if the communication is unsolicited bulk mail or “spam” (whether or not it is commercial in nature);

in a way that forges or disguises the origin of the communication;

in a way which is intended, or likely to, adversely affect the functionality of any computer system (including Waterfront Internet Service’s system)

All accounts will be sent via email and are due and payable with 7 days for dial up and 2 days for ADSL.

5. Inappropriate use of resources

The Service is provided for the benefit of residential users and is not designed or intended for commercial use or for use as a permanent connection. You must not:

use software (such as automated agents) to maintain a connection or to reconnect when you are not personally using such connection;

download software or other material for sale, distribution or other non-personal use;

attempt to make more than one simultaneous connection to the Service;

stay connected to the Service continuously for an unreasonable amount of time, or download or upload an unreasonable volume of data, given the purposes for which the Service is provided to you and the usage

patterns of other users (for example, staying connected continuously for several days, or downloading gigabytes of data in a short period).

Waterfront Internet Service reserves the right to disconnect or separate into a separate pool the users that stay connected to the Service continuously for an unreasonable amount of time, or download or upload an unreasonable volume of data, given the purposes for which the Service is provided to you and the usage patterns of other users (for example, staying connected continuously for several days, or downloading gigabytes of data in a short period).

6. What happens if you breach this Policy?

If Waterfront Internet Service believes on reasonable grounds that you have breached this Policy, Waterfront Internet Service may (but is not obliged to) take one or more of the following steps:

suspend your access to the Service indefinitely or for a specific period;

place time or download limitations on your use of the Service;

terminate your access to the Service and refuse to provide the Service to you or your associates in the future;

Take steps to recover any bad debts owing to Waterfront Internet Service

If Waterfront Internet Service considers that you are in breach of Section 5 of this Policy (Inappropriate Use of Resources, Waterfront Internet Service may (in addition to other steps set out above) place you in a separate pool of users with similar usage patterns in order to free up resources for other users;

inform appropriate government and regulatory authorities of suspected illegal or infringing conduct; and

delete or edit any of your data (including webpage content) stored on Waterfront Internet Service’s computer systems.
